Chengannur:  The High Court dismissed the petition against Chengannur MLA Saji Cherian. A division bench comprising the Chief Justice dismissed the petition seeking the removal of the MLA. The petition alleged that he had made an unconstitutional speech.

The petitioners alleged that Saji Cherian, who was a minister in Mallapally on July 3, spoke disparagingly of the Constitution. Biju P Cheruman, a resident of Malappuram, and BSP state president Vayalar Rajeevan have also demanded that Saji Cherian be removed from the post of MLA. The court heard the detailed arguments in the petition and rejected the demand of the petitioners. The court clarified that there is no legal provision to remove Saji Cherian from the post of MLA.

The bench presided over by the Chief Justice had already pointed out that the demand in the petition is prima facie not tenable. The court observed that the petition could not be accepted in the file and decided to hear the argument after knowing the government’s stand on the matter.
