Split verdict in Hijab Case; The case was left to a larger bench

New Delhi: Split verdict in the case of banning the hijab in educational institutions in Karnataka. The Supreme Court left the case to a larger bench. A petition challenging the High Court verdict upholding the ban was left to a wide bench.

This is in a situation where the bench that heard the case gave a different verdict both against and in favor. While Justice Hemant Gupta upheld the Karnataka High Court verdict, Justice Sudhanshu Dhulia overruled the verdict. The two-judge bench delivered a split verdict in the case and sent it to a larger bench.

A bench comprising Justices Hemant Gupta and Sudhamshu Dhulia heard the case for ten days. Justice Hemant Gupta said in the judgment that the appeal was rejected. Justice Dhulia, in a specially prepared order, announced that the government order is canceled.

The High Court upheld the government order, judging that hijab is not an essential religious ritual in Islam. The High Court pointed out that the government has the authority to impose uniforms in educational institutions and it cannot be seen as a violation of the fundamental rights of students.

The petitioners argued that the government order violated Articles 19 and 21 of the Constitution. The government has the power to intervene only when religious practices become a law and order problem. The petitioners argued that it is the government’s responsibility to create conditions for the exercise of fundamental rights. The petitioners said that the government’s answer is discrimination based on religion and gender.

The Karnataka government argued that the order did not target any religion and was secular. Girls did not wear hijab to college until 2021. During the argument, the government also informed that children started wearing hijab en masse due to the campaign conducted by Popular Front on social media.

The records prove that Eldhos was in Kovalam on the 14th. On 14th and 15th, Eldhos took a room at Kovalam guest house. The woman stated that she was assaulted on the same day. The woman has also stated that PA Danny Paul and his friend Jishnu were with Eldhos.
Therefore, the crime branch team will collect the CCTV footage soon. Based on the woman’s statement, more charges will be filed against Eldhos. The district crime branch went into further action. With the imposition of more sections, the crime branch will have to take action including arrest.

The new variants are reported to be highly invasive. The discovery of the new variants comes at a time when the number of Covid patients is increasing in China. BF.7 is a variant of Omicron’s BA.5.2.1.

The BF.7 was first reported in the Yantai Shagon cities on October 4th. BA.5.1.7 First reported in mainland China. As of October 9th, 1939 people have been infected with Covid through local transmission in China.

This is the highest number of cases since August 20. China is continuing mass testing, border controls, quarantines, and lockdowns to combat the spread of Covid-19. Earlier, the World Health Organization had also come out with a warning against the BF.7 Covid variant.

Vadakkenchery bus accident; The tourist bus driver and owner were taken into custody

Palakkad: The court remanded the driver and the owner of the tourist bus in police custody in the vehicle accident at Anjumoorthy Mangalam in Palakkad Vadakkencherry. The custody was granted for three days till 14th. The police informed the court that a detailed interrogation is required.

The police need to seek clarification on the statement of the tourist bus driver Jomon that the accident occurred because the KSRTC bus was stopped and on Jomon’s careless driving which came out earlier. The police are also investigating whether bus owner Arun paved the way for Jomon to escape after the accident.

In the Vadakkenchery road accident, KSRTC had stated in the High Court that the cause of the accident was excessive speed of the tourist bus. Justice Devan Ramachandran said that the speed limit for vehicles should be tightened and the situation in which children lost their lives is very serious.
